Welcome to Applejuice LLC (“Company”). Your access to and use of our services is conditioned upon your acceptance of and compliance with the following Terms of Use (“TOU”). In this document, you will be referred to as “the Customer,” which includes all your agents, employees, and employers. This TOU, together with any Order Forms and any other specific agreements for services provided by the Company (collectively referred to as "Internet Advertising Services"), constitute the entire agreement between you and Applejuice LLC.

Applejuice LLC reserves the right to modify the TOU at any time without prior notice to you. Such modifications are effective immediately upon posting. It is your responsibility to review the TOU regularly to ensure you are updated on any changes.
Your submission of an order form or your use of any of the Company's services constitutes your binding acceptance of the TOU, confirming that you have read, fully understood, and agreed to its terms. You affirm that you have either taken legal advice or waived the opportunity to do so.

Services Provided:
1. Description of Internet Advertising Services:

Management and operation of your account including billing and web server space.
Web hosting, email services, and domain name registrations.
Website access and use, including site content.
Design and programming services including interface design, graphic design, and database design.
All other services explicitly included in the TOU or otherwise provided by the Company.

2. Data Management and Backup:

You are solely responsible for the management and backup of all data associated with your services, except as otherwise explicitly agreed by the Company in writing.

3. Scheduled and Emergency Maintenance:

Regular maintenance will occur weekly. Services may be unavailable during these times. Emergency maintenance may be conducted at any time with potential service unavailability.

4. License and Property Rights:

You are granted a license to occupy the server space provided; this does not confer any property rights.

5. Domain Name Registrations:

The Company facilitates the submission of domain name registration requests without guaranteeing the success of these submissions.

6. Company's Rights:

The Company reserves the right to refuse service or terminate services to any customer for breach of the TOU without prior notice.

Customer Obligations:

1. Account Use:

Only the registered Customer may use the account and services provided. Transfer or assignment of account use is prohibited without prior written consent from the Company.

2. Legal and Ethical Use:

Services must be used in compliance with all applicable laws and in a manner that is not unethical or damaging to the public or to the Company.

3. Indemnification:

You agree to indemnify and hold the Company harmless from any claims resulting from your use of the services.

4. Prevention of Abuse:

You are responsible for safeguarding against the corruption of data and systems, including virus protection.

5. Mandatory Upgrades:

The Company may require you to upgrade your service package if your usage negatively impacts server performance or exceeds allotted bandwidth.

Termination and Liability:
1. Breach and Termination:

Services may be terminated by the Company immediately upon your breach of the TOU.

2. Limitation of Liability:

The Company's liability is limited to the amount paid by you for the services.

General Provisions:
1. Governing Law:

This TOU is governed by the laws of the Province of British Columbia, Canada.

2. Severability and Waiver:

If any part of this TOU is deemed unenforceable, the remainder remains in effect. Failure to enforce any part of the TOU does not constitute a waiver of that provision.

3. Complete Agreement:

This TOU, along with any associated Order Forms, constitutes the entire agreement between you and Applejuice LLC regarding the services.

By using Applejuice LLC's services, you acknowledge that you have read, understood, and agree to be bound by this TOU.
